Lishaam Seller Terms and Conditions
1. Acceptance of Terms
By registering as a seller on Lishaam, you agree to comply with and be bound by these Terms and Conditions, as well as any other policies or guidelines issued by Lishaam. Your use of the platform signifies your acceptance of these terms.
2. Seller Eligibility
To sell products on Lishaam, you must:
- Be a registered business entity with a valid business license.
- Comply with all local, national, and international regulations regarding the sale of food products.
- Ensure that your products meet Canadian law's quality and safety standards.
3. Product Listings
- Accuracy: All product descriptions, prices, and other information provided must be accurate, complete, and not misleading.
- Compliance: Products must comply with all applicable labeling regulations, including bilingual labeling (English and French), accurate nutritional information, and allergen warnings.
- Prohibited Items: Sellers are prohibited from listing illegal, hazardous products or violating intellectual property rights.
4. Order Fulfillment and Shipping
- Timeliness: Sellers must fulfill orders promptly and within the timeframes agreed upon with buyers. Failure to do so may result in penalties or suspension from the platform.
- Shipping: Sellers are responsible for ensuring that products are packaged securely and shipped according to any regulatory requirements, including temperature controls for perishable goods.
5. Payment Terms
- Payment Processing: Lishaam will process payments on behalf of sellers, deducting any applicable fees before remitting the balance.
- Payout Schedule: Payments to sellers will be made on a regular schedule (e.g., weekly or monthly) after confirming the successful delivery of goods.
- Disputes: In case of payment disputes, Lishaam will mediate based on the platform's transaction records. Sellers must provide all necessary documentation to support their claims.
6. Fees and Commissions
- Commission: Lishaam charges a commission on each sale, which will be automatically deducted from the payout.
- Additional Fees: Sellers may be subject to additional fees for premium services, advertising, or expedited payouts.
7. Returns and Refunds
- Return Policy: Sellers must clearly define their return and refund policies. These policies must comply with consumer protection laws and be communicated to buyers.
- Handling Returns: Sellers are responsible for handling returns and refunds, including any associated costs, unless otherwise specified in their agreement with Lishaam.
8. Intellectual Property
- Rights: Sellers must ensure they have the right to use any intellectual property associated with their products, including trademarks, logos, and product designs.
- Infringement: Lishaam reserves the right to remove any listings that infringe on intellectual property rights without notice.
9. Termination
- Voluntary Termination: Sellers may terminate their account at any time by notifying Lishaam in writing. Any outstanding orders must still be fulfilled.
- Platform Termination: Lishaam reserves the right to terminate or suspend a seller’s account for violations of these terms, illegal activities, or any other reason deemed appropriate by Lishaam.
10. Dispute Resolution
- Mediation: In case of disputes between sellers and buyers, Lishaam will mediate to resolve them. Sellers agree to cooperate fully during the mediation process.
- Arbitration: If mediation fails, disputes will be resolved through binding arbitration, following the rules set by Lishaam.
11. Amendments
- Changes to Terms: Lishaam reserves the right to amend these Terms and Conditions at any time. Sellers will be notified of any changes, and continued use of the platform constitutes acceptance of the revised terms.
12. Governing Law
These Terms and Conditions are governed by the laws of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising under these terms will be resolved in the courts of Ontario, Canada.
